Executive Summary Report – October 2017

The amendment implementing Regulation (EU) No 1286/2014 of the European Parliament and of the Council of 26 November 2014 on key information documents for packaged retail and insurance-based investment products (PRIIPs). 434 deputies supported the bill and only 2 refrained from voting. The bill has been referred to the Senate. The Second Reading of the governmental bill to amend the act on financial market supervision and the act on insurance activity was on 28 September. A day later the voting was held. The new regulations enter into force on 1 January 2018.


On 12 October 2017 during a meeting the Standing Subcommittee on Financial Institutions adopted a draft law on the distribution of insurance.


The Appeal Court in Katowice in its judgment of 9 August 2017 (ref. no I ACa 200/17) ruled that the exclusion of the liability of an insurance company does not take place when a traffic accident has been caused by an insured person who is not authorized to drive or was driving without a license.


The Supreme Court in its judgment of 3 October 2017 (ref. no II UK 488/16) ruled that the remuneration for the contract in parent company by the employee of the daughter company should be treated as remuneration for work.

The Court of Justice of the European Union in its judgment of 27 September 2017 (file C-73/16) ruled that the tax authorities could make public records of suspected taxpayers.


The Ministry of Digital Affairs has completed consultations on drafting a new law on personal data protection. It is related to the general data protection regulation adopted by the European Union in May 2016.


The bill on anti-money laundering and terrorist financing of 26 September 2017 was published on the website of the Government Center for Legislation. The latest version of the draft was created after taking into account the comments submitted to the previous version of the bill.


The Polish Insurance Association (PIA) has published its Annual Report for 2016. The report consists of the following chapters: organizational structure of the Polish Insurance Association, activities of the Polish Insurance Association, insurance market analysis, classification of risks according to branches, classes and types of insurance, list of insurance companies and Polish branches of foreign insurers which are members of the Polish Insurance Association and a list of insurance institutions, organizations and associations.


The new version of the bill of insurance distribution was published. The newest project includes amendments which were introduced during the meeting of the financial institutions commission on 12 October. In comparison to the latest version of the bill, several amendments were introduced mainly by the legislative office in the chancellery of the Polish Parliament. Also, a new definition of ‘a person who seeks insurance protection’ was added in the bill’s dictionary.


Committee on Economic and Monetary Affairs (ECON) has issued a recommendation to postpone the implementation of the Insurance Distribution Directive as of October 1, 2018. The recommendation will be addressed to the European Commission.


On 25 October 2017, the Supreme Court received a motion to adopt a resolution on the liability of the insurance company from the compulsory motor insurance of motor vehicle owners. The Supreme Court will decide whether the insurer is liable for personal injury caused during repair of the vehicle in the workshop due to damage resulting from its operation.


The Supreme Administrative Court in its judgment of 10 October 2017 (ref. no I FSK 498/14) ruled that the services of a doctor who assesses the harm to the health of the injured party are not exempt from VAT.
